reasons for rejection of AUS PR

While many immigrants are successful in obtaining a permanent residency visa in Australia, some applications are rejected. This could be due to a variety of reasons. These are based on the mistakes that applicants make that result in rejection.

Find out why your application was rejected. This can help you figure out what went wrong or where you made mistakes in your application so you can prevent them the next time you apply for a PR visa. To help you, here are the top eight reasons for your PR visa application being denied in 2022.

1. Application for the wrong visa type

The Australian PR visa has three subclasses

  • Skilled Independent Visa Subclass 189
  • Skilled Nominated Visa Subclass 190
  • Skilled Work Regional (Provisional) Subclass 491

The application process is the same for all visa subclasses. The qualifying conditions, on the other hand, are different.

If you apply for a visa category but do not meet the requirements, your PR application may be denied. So, take a look at the criteria for each subclass and decide which one you’re most likely to fit into.

  1. Violation of visa conditions

If your past records demonstrate that you violated the terms of your previous visa, your application may be rejected. If you are on an Australian student visa, this may mean working more than the permitted hours or working while on a visitor visa. Overstaying a temporary visa or failing to follow the terms of a previous visa are examples of other infractions.

Violations of previous visa terms may result in your visa application being denied.

  1. Providing false information

If officials discover that you have not submitted complete information, your visa application may be rejected.

Check before submitting your application to avoid this. Make sure you have given the authorities all of the details and information they require. Send in your application along with all documentation and documents that back up your claims.

Giving false information, such as fraudulent bank details, pretending to live and work in a regional place, forming or misrepresenting relationships to meet spousal visa criteria, or lying about being in a relationship, can lead to your visa application being rejected.

  1. Failure to comply with health regulations

Your application may be denied if you require treatment for any health conditions that the Australian authorities believe will be a financial strain on their medical system. If the applicant has a medical condition such as HIV, cancer, heart disease, or mental illness, his or her application for a PR visa will be denied.

  1. Failure to meet the character standards

Australia is wary of allowing immigrants with a criminal past to enter the country. Individual visa applications are reviewed, and if applicants have a criminal past, a history of harassing others, or are affiliated with a criminal organization, their visa application may be denied.

  1. Inadequate financial resources

Before granting a PR visa, Australian officials want to make sure that the applicant has the funds to maintain their stay in the country. As a result, you’ll need to show proof of your financial situation in the form of supporting financial statements. Insufficient finances or an identity mismatch can result in the rejection of an Australian PR visa application.

  1. Inability to pass an English language proficiency exam

Your PR visa may be denied if you do not achieve the required levels on your English language competence test. In terms of language competency, Australia is demanding, and you must meet the requisite score levels to be eligible for a visa.

8. Failure to pass the visa approval process

If you are unable to clear the verification of your medical or character requirements, or other vital facts in your application, your visa application may be rejected in the final stages.

What can you do if your PR application is rejected?

If your application is rejected, you can inquire about the reasons with the Immigration Department. You must file an administrative appeal with the Administrative Appeals Tribunal (AAT) within the time limit. They’ll go over the decision with you and explain the reasons for rejection.

A review also gives you the chance to explain any points highlighted in the review document and offer any missing information or documents.

You must adhere to the deadline for a review, or you will lose your chance at obtaining a visa. If you submit a complete review application, you will still have a chance to obtain your PR visa.

The AAT has the power to overturn a rejection, give another decision, or send the application to the concerned department for reconsideration.
