Immigrants who arrive in Canada either have to own or rent a property for their residence. The Tenant and Landlord act of Canada defines the conditions that have to be satisfied by both the landlord and tenant who enter into a property agreement for rent. The responsibilities and rights of the landlords and tenants and the process for enforcing them if in case the need arises are stipulated by this act.

Immigrants who do not possess an offer of employment can obtain a rental home with their relatives or friends or ask them to become lease guarantors. It is important to know that even if the tenancy is not defined in writing, the rights of the tenants are still legally enforceable. When the prospective immigrant tenant first enters the property he must be given an information brochure by the landlord provided by the Tenant and Landlord Board. The rent for first and last month is mandatory after selection of property and determination of lease period. The majority of the provinces have the provision of payment of annual interest by the landlord on the money deposited and the rent for last month.

No rental increase can be made effective without prior written notice of three months by the landlord. It is important to give a written reply otherwise it is considered to be an acceptance of the increase of rent.

A termination notice must be given two months earlier to the expiry of the tenancy if it is so intended. In such a scenario prospective tenants can be made to view the property at timings that are mutually agreed. It is always good to have written notices so as to have an amicable settlement of disputes if any.
