Former Overseas students in Ireland who are undocumented have a reason to cheer. Ireland will now permit them to remain in the nation. This is through a new immigration scheme. It will be applicable to those overseas students who were in Ireland via the Student Visas during the period 2005 January and 2010 December.
The new immigration rule permitting the undocumented former overseas students to remain in Ireland is already operational. It will be offered by the Irish Naturalization and Immigration Service. The scheme is valid for 90 days as of now.
All non-EU citizens who arrived in Ireland in the specified period on Student Visas are eligible to apply for the scheme. They must be present in Ireland but without immigration permission. Those who have exited Ireland cannot apply for the scheme.
The Justice Department has said that the new scheme will cater to the concerns raised by the Supreme Court. This was in the Balchand and Luximon cases, as quoted by the journal.ie.
The 2 cases involved 2 nationals of Mauritius. They had arrived in Ireland 11 years back through the Student Visas. The Supreme Court was of the view that they were self-sustaining. These students also viewed Ireland as their home nation, it added.
The Supreme Court also added that the Justice Minister must consider the private life of the individual in specific immigration cases. Any decision that has been arrived at without doing so is unlawful, it added.
The Justice Department has said that the latest scheme offers a pathway to individuals in similar situations. They can remain in the nation and regularize their immigration status.
Applicants whose applications are successful under the scheme will be permitted to remain and work in the State. This is for a period of 2 years. It can be extended for 1 more year if the applicants can demonstrate that they are self-sufficient.
