Reminder from USCIS to Visa Applicants as Widow(er)s

U.S. Citizenship and Immigration Services (USCIS) reminds eligible widow(er)s who want to immigrate to the United States that they must file their visa petitions by October 28, 2011.

Widow(er)s of U.S. citizens who died before October 28, 2009 may be eligible to immigrate to the US if they were married for less than 2 years when their spouse died and they file their Form I-360 for Special Immigrant classification no later than October 28, 2011.

Previously, only widow(er)s who were married for at least two years before the death of their U.S. citizen spouse were eligible to immigrate to the US as an immediate relative. However, this changed from October 28, 2009 when the President signed a new law to amend the Immigration and Nationality Act.

Under the new law, widow(er)s have 2 years from the date of their spouse’s death to file their U.S. visa petition. Widow(er)s of a U.S. citizen who died before October 28, 2009 must file their Form I-360 by mail or overnight courier in time for it to be received by USCIS no later than October 28, 2011.
